Who Can File A Death Claim?

In California, a spouse, domestic partner, children under 22 who are not married and other family members may file a death benefit claim. California death benefits are up to $10,000 for burial expenses and up to $320,000 as cash payments to the dependents of the deceased. Minor children who are dependents of the worker who died can receive payments until they reach 18 years of age.
